LSK demands an explanation for the withdrawal of Graft Cases by the DPP.

The recent and abrupt withdrawal of high profile graft cases by Director of Public Prosecutions (DPP) Noordin Haji, has raised several eyebrows. So far, here are some of the graft cases that have been dropped; 400 million graft case against KPLC former MD Ben Chumo and 10 others, 80 million graft case against former Samburu governor Moses Lenolkulal and 19 million graft case against Aisha Juma a Cabinet secretary nominee.

Dr. Miguna Miguna Lawyer and Political commentator took to his social media accounts yesterday to defend the actions taken by the DPP. He tweeted, “There is absolutely nothing wrong for the @ODPP_KE to apply for the withdrawal/termination/discontinuation of cases they cannot win either because the evidence cannot sustain the charges, or, the charges were politically-motivated. Either way, DPP Haji stands indicted. Cases must never be initiated against innocent Kenyans in order to create work for the @EACCKenya @DCI_Kenya and @Kenyajudiciary. Kenyans should only be charged if there is CREDIBLE EVIDENCE that they have committed crimes and the evidence is SUFFICIENT to convict them.”

The Law Society of Kenya (LSK) has this afternoon, called upon the DPP to publicly reveal the reasons for the discontinuation of these cases. “If the cases are being withdrawn for lack of evidence to sustain the charges. The DPP must take responsibility and explain how the decision to charge was arrived at in the first instance,” Eric Theuri – LSK chairperson. The society hopes that through this revelation Kenyans will restore confidence in the Office of Director of Public Prosecutions (ODPP).
